Every part of Gentoo, including installation images, is free software; most of the source code is available to whoever wants it. Gentoo has been developed in an entirely open process, in which technical choices are made via discussion in email forums and IRC channels rather than by secretive members of some elite development cabal. Each package in Gentoo has its own maintainer who decides whether or not to include it; you are welcome to volunteer to Gentoo.
